In Regulatory Wrap for the week to September 29, 2023:

In this Regulatory Wrap, we discuss the Financial Conduct Authority’s (FCA) new Consultation Paper, which lays out proposals to support diversity and inclusion in the workplace. This proposal seems to tie into recent enforcements clamping down on bad actors for misbehavior and regulators urging firms to uphold good business culture.

Highlights:

1. The FCA’s Consultation Paper outlines proposals to implement firmer frameworks around diversity and inclusion within the financial space

2. The regulator said it’s taking a “clear stance that nonfinancial misconduct, such as sexual harassment, is misconduct for regulatory purposes”

3. This Consultation also states that a lack of diversity and inclusion should be considered a non-financial risk

4. Given the frequency of recent scandals and enforcements against bad actors, as well as the push to promote healthy business culture, this proposal is timely

5. Now, firms should take it upon themselves to cultivate positive workplace environments and suppress misbehavior
