International Jurisdictions & Data Protection
Global Relay - the Expert in International Regulatory Compliance
Every day, millions of messages sent to and from 22 of the 25 largest banks in the world are securely stored and indexed by our systems. Our proprietary technology helps companies in regulated industries such as the financial sector comply with regulatory requirements for archiving, monitoring and eDiscovery of all types of electronic communications.
Global Relay is the expert in moving data across international borders to ensure regulatory compliance. In fact, 95% of our business involves trans-border data flow. Our software-as-a-service solutions are designed to accommodate the message archiving needs of multinational companies - where a wide range of local and national laws, rules and regulations need to be adhered to within one organization. Global Relay's in-house legal team provides international business and regulatory compliance consulting services to customers worldwide.
The message data that we archive on behalf of our customers is stored in Canada, which is considered a "data safe zone" and thus deemed compliant with the stringent privacy and data protection laws of the UK and the EU.
International Data Protection
Global Relay hosts all customer data in fully mirrored SSAE 16 Type II Certified data centers, geographically dispersed in Vancouver and Toronto, Canada. Our systems and services are fully managed from within these data centers.
Having data stored in Canada has distinct advantages for customers in the United States and internationally:
-
For SEC-regulated firms, hosting data in Canada does not pose any compliance issues. SEC/FINRA electronic recordkeeping requirements (such as SEC 17a-4) have no express requirements around physical location of a firm's data. An SEC-regulated firm's electronic records may be located abroad so long as their location remains easily accessible. Global Relay fully supports this mandate and assists companies upon request in promptly providing records to regulatory authorities.
-
Canada has stringent privacy laws to protect personal information. Canada is internationally recognized as a leader in data privacy. The Personal Information Protection and Electronic Documents Act (PIPEDA) protects personal information collected, used and disclosed by private sector companies in the course of commercial business.
-
Global Relay's UK customers are compliant with the UK Data Protection Act. Canada is formally recognized by the UK Data Protection Act as a "data safe zone" in connection with holding and processing data - a requirement for UK firms storing personal data abroad. As well, Global Relay specifically meets the requirements for confidential data processing of personal data set out by the Act.
Global Relay employs a team of four in-house lawyers whose full-time focus is to help customers prepare for, meet and responds to their various legal and compliance requirements. For more information, contact Global Relay today at 1.866.484.6630.
